RULES FOR DISTANCE SALE OF GOODS, TERMS AND CONDITIONS.

OOO ProModa (hereinafter referred to as the «Seller», location: 248008, Kaluga region, Kaluga city, Mekhanizatorov street, house No. 38, room 4; INN: 4029067069 KPP 402901001) offers the opportunity to profitably purchase goods under the general terms of sale (hereinafter referred to as the «Terms»), which are a public offer, in accordance with the Civil Code of the Russian Federation, addressed to an unlimited number of persons, on the conclusion of a contract of sale of Goods under the E.G.M Trademark according to the following rules of distance selling
«ORDER OF GOODS»
By placing an Order for the Product selected on the website www.egmmagazin.ru, the Buyer agrees to these Terms (subject to periodic amendments and additions), as well as to the terms of the Special Offers in effect at that time, available on the website www.en.egmmagazin.ru.
Information about the Products that must be provided to the Buyer in accordance with the legislation of the Russian Federation, namely the Seller’s address, description of the Product, price, delivery terms, etc., is published on the website www.en.egmmagazin.ru
The Buyer will find out information about the Products available for remote sale, their consumer properties of the Product, current at the time of placing the order, in the Seller’s customer service center by e-mail at info@egmmagazin.ru
The name of the Product, its quantity, assortment, main consumer properties are agreed upon by the Buyer with the Seller by phone or by e-mail and are indicated in the Seller’s invoice, on the Product labels, accompanying documentation for the Product, as well as in the form of additional information provided by the Seller.
The Seller does not guarantee the availability of the product in stock, the order manufacturing period excluding delivery may be from 10 days from the moment the Buyer’s order is agreed upon with the Seller. The maximum manufacturing period is individual for each product.
The Buyer places an order for the Product on the website www.en.egmmagazin.ru, by contacting the Seller’s customer service center by e-mail at info@egmmagazin.ru. In this case, the Buyer provides: last name, first name and patronymic, name of the Product, model, article, material, color, delivery address, contact phone number, e-mail address for invoicing. If any of the specified elements are missing, the order is considered unconfirmed. When the Buyer contacts, all data provided by them is considered reliable, belonging to the person who contacted the customer service center, and will be further used for communication and confirmation of the order and delivery conditions. In case of a change in the e-mail address. The Buyer undertakes to notify the customer service center by e-mail at info@egmmagazin.ru. The Seller shall not be liable in the event of the impossibility of sending a confirmation message from the Seller to the e-mail address specified by the Buyer. If the Buyer does not receive a confirmation message from the Seller by e-mail within 2 business days from the date of the call, the Buyer must contact the customer service center again to clarify the data. All messages sent from the e-mail address specified by the Buyer during a telephone conversation with the customer service center, or communicated by him by sending an e-mail, are considered to be sent by the Buyer. The Buyer is hereby warned and assumes the risk of adverse consequences associated with the provision of invalid contact information, including the e-mail address.
The terms of purchase and delivery of the Goods are agreed upon by the customer service center by e-mail. Confirmation of the terms of purchase and delivery of the Goods from the e-mail address provided by the Buyer when contacting the customer service center, including by paying the invoice sent, is considered proper confirmation by the Buyer of agreement with the terms of purchase of the Goods and does not require additional verification by the Seller. The Buyer is warned and assumes the risk of adverse consequences associated with the transfer of access to his e-mail address to third parties, as well as associated with the provision of inaccurate contact information to the Seller.
The Buyer is warned about the Warranty Periods and obligations for E.G.M Products: The warranty period is 50 days; The warranty does not apply to screw fasteners that have the property of self-unscrewing.
All Products offered on the website www.en.egmmagazin.ru comply with the requirements applicable in accordance with the legislation of the Russian Federation to this category of Products
«PAYMENT FOR GOODS»
Prices for the Goods are indicated in Russian rubles and are published on the website www.en.egmmagazin.ru.
Payment is made in full, by bank card, through the payment provider «Robokassa». The Seller does not collect or store the Buyer’s payment information (including the bank card number, the issuing bank of the bank card, its expiration date, secret code).
«DELIVERY OF GOODS»
The Goods are delivered by courier services (hereinafter referred to as the «Transport Company»), the costs of delivery of the Goods are borne by the Seller if the order amount is not less than 5000 (five thousand) rubles. The Goods are transferred to the Transport Company for delivery to the Buyer only after the order has been agreed upon, the quantity, range, main consumer properties, as well as confirmation of payment.
The Goods are delivered personally to the Buyer at the address specified by the Buyer in the order. A representative of the transport company contacts the Buyer to clarify the place and time of delivery of the Goods. Upon receipt of the Goods, the Buyer must provide the courier with an identity document (for example, a passport).
At the Buyer’s request, delivery can be made to a third party. In this case, the Buyer undertakes to inform the Seller about this at the time of ordering. This person is indicated in the accompanying message as the Recipient and delivery is made to his address.
Upon receipt of the Goods, the Buyer has the right to open the parcel and check its contents. Clothes fitting, as well as returning unsuitable Goods to an employee of the Transport Company, is not provided for according to the rules of the Transport Company.
By signing the confirmation of delivery of the order, the Buyer confirms that the Goods have been accepted, the outer and inner packaging of the Goods are not damaged, and the Goods are in proper condition
«RETURN OF GOODS»
The Buyer has the right to refuse the Goods of proper quality at any time before their transfer, at the time of transfer of the Goods by the courier and after their transfer — within 7 calendar days, provided that their presentation, consumer properties, as well as the document confirming the fact and conditions of purchase of the said Goods are preserved. Refusal of the Goods of inadequate quality is possible within the timeframes and in the manner stipulated by the legislation of the Russian Federation.
The refund of the amount paid by the Buyer is made no later than 10 (ten) calendar days from the date of the Buyer’s presentation of the relevant claim. The date of the Buyer’s presentation of the claim for return is the date of receipt by the Seller of the returned Goods and confirmation of the preservation of their presentation and consumer properties, and in the case of return of the Goods of inadequate quality — the date of receipt of the Goods by the Seller, provided that there is confirmation of its inadequate quality.
The refund of the amount paid by the Buyer is made in non-cash form in the same way as the payment for the Goods was made. When paying by bank card, the refund is made by transferring the amount paid to the Buyer’s bank card from which the payment for the Goods was made. When paying to the Seller’s bank account, the refund is made by transferring funds to the Buyer’s bank account from which the payment for the Goods was made.
The return of the Product is carried out by the Transport Company. If the Buyer wishes to refuse the Product (regardless of whether it is of proper or improper quality), the return is carried out by submitting an application to the Seller’s customer service center. Coordination is carried out by e-mail. If the Buyer does not receive a confirmation message from the Seller by e-mail within 2 business days from the date of the call, the Buyer must contact the customer service center again to clarify the data. When using the services of courier services to return the Product, the Buyer is responsible for the proper fulfillment of their obligations by such services.
In case of returning the Product of proper quality, the costs of returning the Product are borne by the Buyer. In case of returning the Product of improper quality, the costs of returning the Product are borne by the Seller.
If the Buyer agrees to use the transport services of the Transport Company to return the Product of proper quality to the Seller, the Seller transfers funds to the Buyer’s bank account minus the costs of transporting the Product. The representative of the Transport Company informs the Buyer about the cost of transportation at the time of registration of the return and duplicates this information to the Buyer’s personal email address. By signing the application for the return of the Goods, the Buyer agrees that the cost of transportation will be withheld when returning funds to his bank account.

«SPECIAL CONDITIONS»
These Rules do not apply to the sale of Goods to legal entities and sole proprietors. Orders for distance selling from legal entities and sole proprietors are not accepted.
By placing an order, the Buyer gives the Seller consent to the processing of his personal data specified in the order in any manner permitted by the legislation of the Russian Federation, including cross-border transfer, for the purposes of fulfilling the retail sale and purchase agreement and other agreements or pre-contractual (non-contractual) obligations with the right to transfer such data to the Transport Company in the amount necessary for the delivery of the Goods. At the same time, the Buyer agrees that this consent is recognized as consent in writing in cases where such consent is required in accordance with the Federal Law «On Personal Data». The Buyer also gives consent to the Seller to communicate advertising information about the Seller, its goods and services through the specified contact details. Such consent is valid indefinitely until it is revoked by the Buyer.
All disputes and disagreements that may arise between the Parties on issues related to the conclusion, execution and termination of the retail sale and purchase agreement will be resolved through negotiations based on the current legislation of the Russian Federation. Disputes not settled during the negotiations will be resolved in court in the manner established by the current legislation of the Russian Federation.
All claims related to the conclusion, execution or termination of the retail sale and purchase agreement are accepted by ProModa LLC at the address specified in these Rules
